Terms of Use & Disclaimer

1. Subject

Helmlet is a utility for macOS that can keep the Mac awake, control the fans manually and display the CPU temperature. These terms govern the use of the software.

2. Intervention in thermal management

Helmlet can change the sleep, energy and fan behavior of your Mac. Despite built-in safety mechanisms, an early-ramping fan curve, automatic handover of control to macOS on heat, and a monitoring watchdog, it cannot be guaranteed that the software works flawlessly on every device, under every macOS version and in every situation. Manually intervening in thermal management can carry risks in principle.

3. Disclaimer of liability

To the extent permitted by law, any liability of the provider for damages arising directly or indirectly from the use or inability to use the software is excluded, in particular for overheating, hardware damage, reduced cooling performance, throttling, freezing or crashes, data loss, lost profit or other consequential damages.

4. Mandatory exceptions

The above disclaimer does not apply to damages arising from injury to life, body or health, nor to intent and gross negligence, nor to the breach of expressly assumed guarantees, nor to mandatory liability under the German Product Liability Act. In the event of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical for the contract.

5. Apple's hardware protection

Independently of Helmlet, Apple's built-in hardware protection against over-temperature (throttling/emergency shutdown) remains active at all times and cannot be switched off by the software.

6. License

With your purchase you receive a simple, non-transferable right of use for the number of devices stated with the product. Sharing or publishing the license key is not permitted.

7. Final provisions

German law applies. The purchase contract is concluded with the Merchant of Record (Lemon Squeezy); their general terms apply in addition. Should any provision be invalid, the remainder of the contract remains effective.
